Kano Emirate Tussle: Court Rejects Sanusi’s Reinstatement as Emir

Nigerian Court Throws Out Bid to Reinstall Former Emir

A high court in Kano, Nigeria, has thrown a wrench into the recent attempt to reinstate Muhammadu Sanusi II as the Emir of Kano. The June 20th ruling by Justice Abdullahi Liman not only nullified Sanusi’s reinstatement but also struck down all actions taken by the Kano State government following the controversial move.

Background of the Dispute

The current situation is rooted in the 2020 dethronement of Muhammadu Sanusi II, a prominent figure who had previously criticized the Kano State government’s handling of public finances. Governor Abdullahi Ganduje accused Sanusi of disloyalty, leading to his removal from the position of Emir. Sanusi, however, challenged this decision in court, arguing that his removal was unlawful.

In his judgment, Justice Liman highlighted a key factor in his decision: the Kano State government’s disregard for a previous court order. This order mandated the state to maintain the status quo – essentially preventing any changes related to the Emirate – until the legal case regarding Sanusi’s removal could be resolved.

“The court is convinced the respondents [Kano State government] were aware of the order to maintain the status quo,” Justice Liman stated. He expressed strong concern about the government’s blatant disregard for the court’s authority, emphasizing the potential for “serious consequences” if such actions become commonplace.

The judge argued that following proper legal procedures, including adhering to the court order, could have prevented the current situation. He placed the blame squarely on the shoulders of the Kano State government for acting on “whims and caprices,” ultimately leading to this legal entanglement.

Uncertain Future for Sanusi’s Return

The court’s decision throws Sanusi’s potential return to the throne into significant uncertainty. While the judge clarified that the Kano Emirate Council Law itself remains valid, the specific actions taken to reinstate Sanusi and dismantle the previously established emirates are now nullified.

This ruling is likely to be appealed by parties involved in the dispute, extending the ongoing legal battle surrounding the Kano Emirate. It remains to be seen how this complex situation will be resolved and who will ultimately hold the position of Emir.

The court’s decision has the potential to reverberate throughout Kano State. The dispute over the Emirate has generated significant public interest, with supporters on both sides of the issue.  Moreover, the uncertainty surrounding the future leadership of the Emirate could lead to continued tensions within the state.
