Police Warn Citizens Against Resisting or Obstructing Officers

Understanding the legal consequences of obstructing public officials

The Nigerian Police Force has in rather clear terms reminded Nigerians about the law on hindering officials while in the course of their duties.

In a statement signed by Force Public Relations Officer Muyiwa Adejobi, the police outlined penalties under the Criminal Code Act and the Police Act 2020.

These laws point to the need of social collaboration with police and judicial persons to facilitate order and security of the society.

A provision is Section 197 of the Criminal Code Act, which states, that whoever resists or obstructs a public officer in the execution of his or her duties commits an offense and is liable to imprisonment liable to imprisonment for two years.,

Similarly, Sections 42, 98, and 99 of the Police Act 2020 specify fines and imprisonment for various acts of resistance or failure to assist officers in need.

Penalties for resisting public officials

Section 98 of the Police Act 2020 categorically deals with assault or obstruction of a police officer; anyone convicted of the crime attracts a penalty of N500, 000, six months imprisonment, or both.

Additionally, failure to assist an officer in distress as provided under Section 99 attracts fine of N100, 000 or three months imprisonment.

“These laws are in place to protect those who risk their lives daily to maintain public order,” said Adejobi. The statement acts as a threat to any persons that might choose to ignore legal commands or try to interfere with due process.

Public cooperation as a pillar of law enforcement

According to Punch, the police also highlighted Section 42, which mandates citizens to assist law enforcement when reasonably called upon.

Literally, in cases of an arrest or attempting to escape the law, or in any other way, the citizens are legally required to assist the officers.

People are equally involved in the enforcement of the laws of the land. Cooperation makes sure justice is done and with no harm to anybody,” Adejobi further said.

The statement is directed at Nigerians to focus on the fact that all those laws are made to help everybody to avoid and prevent any lawlessness and criminality.
